A PATTERN OF JURY NULLIFICATION FOR THE FAILURE TO GAIN CRIMINAL CONVICTIONS OF POLICE OFFICERS

The BLACK LAW ENFORCEMENT ALLIANCE® cites jury nullification as a reason for the acquittals of Police Officer Kenneth Moreno and Franklin Mata for Rape. Jerome Rice, Director of Community Relations states, “The victims of Police criminality have to overcome so many obstacles. First, reporting the crime to the agency that employs the offenders. Second, cooperating with a district attorney’s office that maintains an incestuous relationship with the NYPD, and lastly hoping that a jury of your peers realizes that the conviction of a Police Officer is not an indictment of the entire Police Department. Recent history has shown that both juries and prosecutors too often give Police criminals a ‘pass’ on the top and most serious charges.”
